I had the privilege of speaking at the Web3 Creator Summit in June, where I participated in a panel discussion on the future of NFTs. This engaging conversation sparked deeper thoughts and insights that I’d like to share, combining perspectives from the panel and my own observations.

One of the central themes of our panel discussion revolved around the significance of community within the NFT ecosystem. Each panelist, including Jenny Zheng from Bybit NFT, Karen Shidlo from Fiat24, Hugo Gong from Westminister Business School, and Anndy Lian, an Intergovernmental Blockchain Advisor, provided valuable insights. Moderating the discussion was Carmac Rowe, an NFT Enthusiast.

Karen emphasized the crucial role that community plays in establishing connections and fostering engagement. She explained how even companies offering utility tokens can benefit from building a strong community. Karen’s own company, Fiat24, relies on platforms like Telegram and Twitter to create personal connections and provide financial services to their community members.

Jenny added to the discussion by highlighting the influence of the type of NFT asset on the importance of community. While art NFTs may not heavily rely on community engagement, other types of NFTs, such as game assets or profile picture (PFP) projects, thrive on community involvement. Building an active and passionate community becomes vital for the success of these projects.

I agreed with the panelists, stressing the need for real communities rather than just a high number of members. In my view, active users and meaningful engagement are more valuable indicators of a strong community than sheer numbers.

Evaluating NFT Projects

During the panel discussion, Jenny shared valuable insights into the process of evaluating NFT projects based on her experience at Bybit NFT Marketplace. She highlighted key factors that play a significant role in their decision-making.

Firstly, they consider the project’s community and its level of engagement. A vibrant and active community indicates the potential for success. The craze surrounding profile picture NFTs (PFPs) peaked during the last bull run, but the landscape has since changed. Today, the exorbitant prices associated with PFPs, often lacking tangible utility, are less likely to attract buyers.

The true value of NFTs lies in their ability to empower communities to come together and create meaningful experiences. Imagine owning a PFP that grants you exclusive access to special events or allows you to establish localized chapters of like-minded individuals worldwide. These rights and privileges bestowed upon NFT holders offer a unique form of utility that goes beyond traditional physical benefits.

It’s important to note that the days of paying exorbitant amounts for a PFP are likely behind us. While the direction of the market remains uncertain, it’s unlikely that we will witness similar million-dollar sales for profile pictures in the future.

The Growing Influence of Bigger Brands

An important trend in the NFT space is the increasing involvement of larger brands. Established names like Red Bull, Starbucks, and Gucci are actively exploring ways to engage with their communities and customers through NFTs. By leveraging blockchain technology and digital assets, these brands are forging new avenues for interaction and brand loyalty.

It’s vital to recognize that the entry of bigger brands has contributed to a decrease in transactional volume and pricing. Many of these brands are not seeking exorbitant profits from NFT sales but are instead focused on building stronger connections with their communities. As a result, the utility-driven adoption of NFTs is gaining momentum, catering to a broader user base beyond the traditional cryptocurrency enthusiasts.

Exploring New Use Cases: The Future of NFTs

Looking ahead, the potential use cases for NFTs are virtually limitless. Beyond their collectible nature, NFTs have the potential to revolutionize various industries and offer innovative solutions. Here are some potential use cases that have garnered attention:

Digital Identity and Authentication: NFTs can revolutionize digital identity and authentication systems by associating specific NFTs with user profiles, creating a unified digital identity across multiple platforms and services.

The Hong Kong Monetary Authority (HKMA) has made an exciting announcement regarding the launch of the e-HKD Pilot Programme. This initiative involves the participation of 16 carefully selected firms from the financial, payment, and technology sectors. The primary objective of the program is to explore and identify potential use cases for the e-HKD across various categories, including payments, programmable payments, offline payments, tokenised deposits, settlement of Web3 transactions, and settlement of tokenised assets.

Chief Executive of the HKMA, Eddie Yue has expressed his enthusiasm for the e-HKD Pilot Programme and its potential to explore innovative use cases while laying the groundwork for the possible implementation of the e-HKD. He has also acknowledged and appreciated the active participation of industry stakeholders in the pilot projects, and extended gratitude to the academic experts who are contributing their knowledge and experience to this important CBDC initiative. The ultimate goal is to foster collaboration among all stakeholders and ensure that the research and development efforts align with practical business opportunities.

The e-HKD Pilot Programme represents a significant step forward in the HKMA’s approach to the development of a potential retail central bank digital currency (CBDC). By working closely with stakeholders, the HKMA will conduct a series of pilot projects aimed at examining use cases and addressing implementation and design challenges associated with the e-HKD. The valuable insights gained from these pilots will inform and enhance the HKMA’s overall strategy and decision-making process in relation to the potential implementation of the e-HKD. It is important to note that a final decision to introduce the e-HKD has not been reached at this stage.

At the commencement event, senior executives from the selected firms had the opportunity to present the key highlights of their proposed use cases. In the coming months, the HKMA will maintain close collaboration with these firms, closely monitoring the progress of the pilot projects. While the specific outcomes may evolve and develop over time, the HKMA plans to share the key learnings and insights with the public during Hong Kong FinTech Week 2023. Additionally, the HKMA has expressed its intention to continue conducting further rounds of pilots in collaboration with industry stakeholders in the future.

In order to facilitate effective collaboration between the government, industry, and academia in the realm of CBDC research, the HKMA will establish a dedicated CBDC Expert Group. Comprised of leading academics from local universities, this group will provide invaluable insights and expertise on policy and technical issues relevant to CBDC, including privacy protection, cybersecurity, and interoperability.

SEC removes digital assets from hedge fund rule: What does it mean for the future of digital asset regulation

The U.S. Securities and Exchange Commission (SEC), which regulates the securities industry, has recently decided about digital assets. Digital assets are virtual or digital currencies that can be traded or exchanged. The SEC previously defined digital assets as securities in its hedge fund rule, subjecting them to additional regulations.

Hedge fund rule

The hedge fund rule, officially known as Rule 206(4)-8 under the Investment Advisers Act of 1940, is a rule created by the U.S. Securities and Exchange Commission (SEC) to prevent investment advisers from making false or misleading statements to investors in pooled investment vehicles such as hedge funds.

The rule imposes additional reporting and disclosure requirements on advisers to hedge funds and other private funds and requires them to implement specific compliance programs and risk management measures. The rule is designed to protect investors and maintain the integrity of the financial markets by ensuring that investment advisers act in their client’s best interests and provide accurate and complete information about their investment strategies and risks.

In the context of digital assets, the SEC included a definition of “digital assets” as securities in its hedge fund rule, subjecting them to additional regulations. However, the SEC recently removed this definition, indicating that it is still evaluating the term and has not yet decided whether digital assets should be classified as securities.

New asset class for “digital assets”?

Many people have been surprised by this move and have questioned the SEC’s approach to regulating digital assets. It’s worth noting that SEC Chair Gary Gensler gave a speech before the House Financial Services Committee on April 18, 2023, regarding the agency’s stance on digital assets. The hearing was not dedicated exclusively to the SEC’s crypto strategies, but the regulatory agency’s chairman faced criticism over perceived regulatory overreach and lack of clear crypto classification. During the hearing, Gensler refused to comment on whether Ether (ETH) was a security or a commodity, saying it depends on the facts and the law, despite being told he knows. It is worth noting that the U.S. House Financial Services Committee and House Agriculture Committee are set to put together legislation to oversee the crypto sector. The bill will be introduced within the next two months.

Having said so, I do see this in a more positive light. This suggests that the SEC is working on a regulatory framework for digital assets, and this decision may be part of a larger strategy. The SEC may have removed the definition of “digital assets” from the hedge fund rule to allow for further consideration and evaluation of the appropriate regulatory approach for this new asset class. The SEC could be taking a cautious approach to ensure that any regulatory framework it develops is appropriate for digital assets’ unique characteristics and addresses potential risks without hindering innovation.

Regulating digital assets is complex and contentious

Experts have commented on the SEC’s decision to remove its previous definition of digital assets as securities, which would have subjected them to additional regulations. Coinbase, a major player in the crypto industry, has publicly opposed the SEC’s stance on regulating digital assets. Some experts believe that the digital assets sector needs to focus more on risk management and operational due diligence, coupled with thoughtful regulation, to repair its reputation.

It’s essential to recognize that the SEC has had a changing stance on digital assets, and this recent decision isn’t the first time they’ve taken a position on their classification. Previously, the SEC confirmed that a 401(k) plan could be considered a single investor under section 3 (c) (1) and a qualified purchaser under section 3 (c) (7) if plan participants have investment discretion to allocate their accounts.

The question of how to regulate digital assets is complex and contentious. In addition to the points made, some argue that digital assets fundamentally differ from traditional securities and should be treated as a separate asset class. Because they operate on a decentralized network, digital assets aren’t subject to the same regulations and oversight as traditional securities. This lack of regulation has led to concerns about market manipulation, fraud, and other illicit activities.

Moreover, digital assets aren’t backed by physical assets or government guarantees, which makes them inherently risky. However, they also have the potential for high returns, which can entice investors who are willing to take on more risk in their investments. Due to these unique characteristics, some experts suggest that digital assets require a different approach to risk management, valuation, and investment strategies than traditional securities.

The evolving nature of the digital asset market may require clearer regulatory frameworks and standards as it matures. However, there is uncertainty surrounding how these assets will be classified and regulated and how this will affect the overall market. Digital assets have unique characteristics that differentiate them from traditional assets, including decentralization and the use of blockchain technology. This technology enables borderless transactions, smart contracts, and decentralized applications that offer new investment opportunities for retail and institutional investors.

Ending remarks

The growth of the digital asset market has attracted significant attention from regulators and investors, with some arguing that digital assets should be treated as securities to protect investors from fraud.
