Segundo presidente da CVM, decreto que regulamenta mercado de criptomoedas será publicado em breve

Na semana que o presidente da CVM dá declaração sobre cripto, vão avançando ao redor do mundo as discussões e iniciativas que têm por finalidade regulamentar a emissão, compra e venda dos criptoativos, inclusive criptomoedas como o Bitcoin e o Ether.

Esses esforços recebem considerável impulso da revolta e do choque públicos com escândalos, como os dos colapsos da corretora FTX e da criptomoeda Luna no ano passado, e dos prejuízos e instabilidade resultantes.

O Legislativo da Coreia do Sul, por exemplo, tem diante de si quase duas dezenas de propostas sobre a regulamentação das criptomoedas, de cujo debate deve sair um marco regulatório para essa classe de ativos no país asiático. Na França, recentemente, aprovou-se uma regulamentação mais dura para a emissão de licenças de atuação de empresas do setor cripto.

Brasil já tem marco regulatório das criptomoedas

No Brasil, foi aprovado pelo Congresso e sancionado pelo então presidente Jair Bolsonaro um marco legal para o setor de criptomoedas, a Lei 14.478, de 2022, que deve entrar em vigor em junho deste ano, quando terão passado 180 dias de sua publicação, que aconteceu em dezembro do ano passado.

Elogiada em suas linhas gerais, a Lei 14.478 teve algumas omissões apontadas, como a falta de definição quanto de qual será o regulador do mercado de criptomoedas. A aposta mais comum no mercado é de que as responsabilidades de regulação e supervisão vão ser repartidas entre Banco Central e Comissão de Valores Mobiliários.

Outro aspecto de que a peça legislativa não tratou, mas que observadores consideram necessária ou pelo menos conveniente, é a segregação patrimonial, ou seja, a separação entre os fundos das exchanges e os que pertencem aos clientes delas.

Os dois pontos, aliás, foram abordados pelo presidente da Comissão de Valores Mobiliários, João Pedro Nascimento, em um evento sobre economia digital promovido por empresários do LIDE (Grupo de Líderes Empresariais) na manhã do dia 2 de março.

Além de negar divergências com o atual governo, com quem, afirmou, o diálogo da instituição que lideram é muito bom, o presidente da CVM argumentou que, embora tenha sido um avanço para o setor de criptomoedas no país, o marco regulatório foi, em alguns dos aspectos, tímido.

Como exemplo da timidez que vê na lei em questão, apontou a ausência da prescrição de segregação patrimonial nas relações entre exchanges e clientes. Ele também afirmou que deve ser publicado nos próximos dias o decreto que regulamentará o mercado de criptomoedas.

Nascimento disse esperar que um dispositivo dessa lei reserve à Comissão de Valores Mobiliários poder para lidar com todos os criptoativos que possam ser enquadrados como valores mobiliários.

Para o presidente da autarquia, que tem o dever de supervisionar o mercado de capitais, devem ser considerados valores mobiliários os criptoativos que sejam contratos coletivos de investimento ou que sejam representação digital de outros valores mobiliários.

Enquadramento de criptoativos como valores mobiliários já tem precedente nos EUA

A questão de que criptoativos devem ser tratados como valores mobiliários e ter estendida a si a supervisão dos reguladores responsáveis pela supervisão dos mercados dos ativos dessa classe é uma das mais acesas polêmicas do momento no âmbito dos esforços de regulamentação dos ativos digitais.

Recentemente, por exemplo, a Securities and Exchange Commission, equivalente estadunidense do CVM, multou a corretora Kraken em US$ 30 milhões de dólares e forçou-a a fechar sua plataforma de staking sob a alegação que se tratava do oferecimento de títulos não registrados.

Outro caso recente que pode colaborar para estabelecer a fronteira – se houver – entre criptoativos e valores mobiliários, é o do processo sendo movido contra a Dapper Labs, responsável pela emissão de tokens não fungíveis (NFTs) da NBA.

Segundo a acusação, os ativos em questão são valores mobiliários e deveriam ter sido registrados previamente com a SEC. A defesa, porém, alegou, entre outros pontos, que as figurinhas colecionáveis são o equivalente digital às tradicionais figurinhas de esportistas.

O juiz Victor Marrero, do Tribunal do Distrito sul de Nova Iorque, rejeitou em sua decisão a comparação feita pela defesa e rejeitou o pedido feito por esta para arquivamento do processo, que deve receber andamento.

Uma porta-voz da Dapper Labs lembrou à imprensa que não se tratava de um julgamento do mérito da questão, apenas da plausibilidade das alegações da acusação, e afirmou que a empresa está confiante na vitória, que seria uma repetição de precedentes legais que foram repetidamente estabelecidos pelas cortes nos Estados Unidos.

Recentemente, o presidente da SEC Gary Gensler confirmou que o entendimento da instituição é que o Bitcoin não é um valor mobiliário, mas sim uma commodity, sob a supervisão da Commodity Futures Trading Commission (CFTC). As altcoins, as outras criptomoedas, são valores mobiliários.

A afirmação do regulador americano causou discussões na comunidade cripto. Há aqueles que consideram o enquadramento de todas as criptomoedas com exceção do Bitcoin como valores mobiliários excessivamente amplos. Para eles, existem criptomoedas que não se encaixam na definição de valor mobiliário da Securities and Exchange Commission.

Outros, porém, pensam que a abordagem enunciada por Gensler é essencial para que o público possa ser protegido de atividades fraudulentas ou de manipulação do mercado no setor de criptoativos, contra as quais deve haver salvaguardas como há em na negociação de outras classes de indivíduos.

Como observou Anndy Lian em artigo no site CryptoSlate, uma das implicações mais importantes da observação de Gensler é que ela significa que muitos criptoativos podem ser colocados sob a supervisão da SEC.

Um exemplo que ele aponta de atividade que pode sofrer crescente interferência do regulador é a realização de Initial Coin Offerings (ICOs), campanhas de arrecadação de fundos para projetos em que tokens são trocados por criptomoedas como o Bitcoin.

Segundo o articulista, muitos ICOs sofreram críticas pela falta de transparência e de responsabilização dos seus realizadores. Nos últimos anos, o SEC tomou medidas contra vários dos emissores de ativos digitais oferecidos nesses eventos.

Outra possível consequência da visão enunciada por Gensler é a sujeição das exchanges à SEC, responsável, segundo a legislação americana, por fiscalizar a atuação das corretoras que viabilizam a negociação de valores mobiliários.

Embora tenha feito reparos ao que vê como timidez da Lei 14.478. Nascimento, em sua conversa com empresários, deixou claro que as omissões e lacunas do marco legal devem ser supridas, mas que, na sua essência, ela não será alterada.

Ele ressaltou também que os criptoativos podem ser uma importante ferramenta para o desenvolvimento nacional em uma direção moderna e amigável ao Meio Ambiente. Por exemplo, a tokenização permite que créditos de carbono emitidos em nome de empresas brasileiras possam ser adquiridos por compradores de todo o planeta, ajudando a regular as emissões de gases causadores do efeito estufa.

A confiança do público, lembrou o presidente da CMV aos presentes, sofreu abalos causados por diversos escândalos e fraudes envolvendo criptomoedas, mas, embora isso seja uma razão a mais para que o setor público seja diligente na regulamentação e fiscalização do mercado desses ativos, não é motivo para que se ignore o potencial que as inovações em ativos digitais oferecem ou para que se esqueça da existência de pessoas e instituições honestas no setor cripto.

O presidente da CVM também afirmou esperar poder anunciar ainda em 2023 o Open Capital Market, fase do processo de descentralização das finanças, que se segue à introdução, já implementada, do Open Banking e do Open Finance.

Crypto community reacts as Bitcoin bear market fears continue

The crypto market saw a sharp decline at 12 am UTC on March 3. The price of Bitcoin (BTC) fell by over 5% from around $23418 to $22163, according to CryptoSlate data. Most of the drop occurred within an hour as the BTC price fell by over $1,000 in seconds.

The price of the second-largest cryptocurrency followed suit with a 5.4% decline from around $1,643 to $1,554 around the same time.

Many other cryptocurrencies also suffered losses as Dogecoin (DOGE) slipped 5.8% over the past 24 hours, while Cardano (ADA) and XRP (XRP) are down 3.78% and 2.73%, respectively.

The fall in crypto prices triggered liquidations that crossed $251 million over the past 24 hours, most of which were triggered after the sharp dips in prices, according to Coinglass data.

Binance saw the most liquidations, around $90 million over the past 24 hours, the data indicates. OKX followed at a close second with $75.83 million of liquidations over the past day.

Over $222 million worth of long positions were liquidated, while short positions made up a little over 8% of the total liquidations over the past 24 hours, Coinglass data shows.

Total Ethereum (ETH) positions liquidated over the past day stood at $49.24 million. BTC liquidations stood at $84.06 million, according to Coinglass.

What caused the dip

Crypto bank Silvergate is owned by Silvergate Capital Corporation, whose share price dropped 49% upon the announcement that it will delay its annual report to the Securities and Exchange Commission. The firm said it needed more time to complete its audit.

Silvergate bank said that it may file for bankruptcy owing to a massive sell-off. It is also unable to repay its debts. Many firms, including Coinbase, Circle, and Paxos severed all ties with the troubled bank.

Regarding the crypto market, Sora Ventures CEO Jason Fang told CryptoSlate:

Obviously there’s the current fud surrounding Silvergate and Binance, and we think that the market isn’t in a clear bull yet, but there are some certain sectors that outperform everytime the market dumps, it could be sectors surrounding L2, LSDs, zk rollups, etc. Since the narrative is different every time, we think keeping an eye on the market during these drops is definitely worth it, and its a good metric to observe which sectors the smart money is betting on.

Alex Kuptsikevich, FxPro senior market analyst, believes the crypto market tumbled in reaction to Silvergate’s uncertain future. He told CryptoSlate:

“The plunge into this area came as a market reaction to the potential bankruptcy of Silvergate. The news triggered a wave of stop orders on fears that the situation could cause a domino effect in the industry.”

Kuptsikevich said that the dip pushed Bitcoin’s price below its 50-day moving average, “which does not bode well for the short-term outlook, although this signal will only be reliable at the close of the day.”

He added that the market sentiment is “moderately positive” and supports the “buy-the-dip” mood. Many Twitter users claimed to have bought Bitcoin and taken advantage of the price fall.

But many investors panicked and, per Kuptsikevich, were scared that the Silvergate crisis could soon escalate to the FTX level.

In response to the latest events, investor Anndy Lian told CryptoSlate:

“Silvergate Bank’s share price has fallen by more than 50% to an all-time low after it announced it would review its books with auditors and warned of several headwinds. A vast majority of the bank’s crypto-friendly industry clients have left or are leaving the company, including Coinbase, Circle, Paxos, Crypto.com, Galaxy, and Gemini which have all suspended business with the bank. The bank’s clients leaving was reported to have happened less than a day after the announcement of the audit review.

This means that it is now harder for crypto companies to sustain relationships with a U.S. bank. Many institutional clients will not be able to transact big amount of crypto until they find better safer solutions to work around. As we speak, I know some of my friends are moving their funds out of some banks in Puerto Rico.

There will be a big vacuum in the short term. I know many of the crypto organisations are now looking for offshore solutions and the more adventurous ones are shifting to Asia to run their trading desks.”

Many analysts claim the recent dip is a signal for the BTC price to keep going down, but others are more optimistic. Quantum Economics CEO Mati Greenspan told CryptoSlate:

“Including yesterday’s sudden dip, Bitcoin and crypto are having one of their strongest years ever. No major support lines have been broken and the long term chats look bullish as ever.”

Bitcoin, the world’s largest digital currency, surged last week, breaking past the $25,000 mark and reaching a new high for 2023. This was an almost 60 percent gain for the cryptocurrency from the low of $15,742 in 2022 following the FTX crisis in November. Bitcoin’s value has been increasing steadily since then.

The last time Bitcoin was at a similar level was in mid-June of 2022, after which it stagnated for a prolonged period, with values hovering in the $19,000 to $21,000 range for several months. The cryptocurrency is still well below its peak of $68,992, which it reached in November 2021.

Experts said that while the surge above $25,000 was a positive sign, the market remains susceptible to sudden changes. They advise investors to remain vigilant and prepared to react quickly to market movements.

According to Ben Sharon, cofounder of LumiShare SRG, factors such as regulatory changes, geopolitical tensions, and the performance of major players like Bitcoin will all have an impact on the market, which looks positive at this stage. “The bull market will begin within the next two quarters,” Sharon told Moneycontrol.

Matter of regulation

Another market analyst said Bitcoin is still largely misunderstood or misrepresented and the real question for investors is how regulatory authorities treat the cryptocurrency ecosystem.

Nathan Thompson, a lead tech writer at Bybit, noted that Bitcoin is currently traded as a risk asset and is affected by many macro factors. These include inflation, recession, and general discourse, which have a direct impact on the price of cryptocurrency.

Thompson emphasised that Bitcoin and other blockchain-based assets are a net gain in terms of access and efficiency and if allowed to flourish, they will increase productivity and growth worldwide. Sean K. August, CEO of The August Wealth Management Group, said crossing the $25,000 mark is a significant milestone for Bitcoin, which could potentially continue to rise in the short term.

However, the future of Ethereum, the second-biggest cryptocurrency by market capitalisation, may depend on factors such as the adoption of the Ethereum blockchain and the launch of new projects and applications.

August said the crypto market is highly volatile and subject to fluctuations, influenced by factors such as regulatory changes, adoption by institutional investors, and the macroeconomic environment. Modulus CEO Richard Gardner notes that the macroeconomy is only moving the market for the short term, and the real question for Bitcoin investors is how regulatory authorities will treat crypto.

Until there is regulation, the sector will be stuck in a holding pattern. Gardner predicts that crypto will truly break free in a meaningful way only when regulatory authorities provide oversight.

Intergovernmental blockchain expert Anndy Lian said the recent surge in BTC price cannot be attributed solely to its intrinsic value – it is also heavily influenced by the current global economic climate. Bitcoin is viewed as a safe haven asset and its decentralised nature makes it an attractive option for those who are sceptical of traditional financial institutions.

Whitney Setiawan, a research analyst at cryptocurrency exchange Bitrue, has predicted that the current market for Bitcoin and Ethereum could signal the start of a bull run in the near future. According to Setiawan, the crypto market is influenced by factors such as inflation slowing globally and the US Federal Reserve taking a slightly dovish tone.

Setiawan cited the bottoming of crypto prices and the buy-on-the-dip mentality of traders as the main drivers for the recent price surge. Setiawan noted that historically, bear market rallies with a parabolic upward movement are quite common before a substantial decrease in price, and this could be the case this time as well.
